Superior Court Judge Jeffrey S. Bagley ordered the State
of Georgia to return $330,000 to the Final Exit Network
(FEN). The money was seized in February when four FEN
members were charged by the Georgia Bureau of
Investigation with assisting the suicide of John Celmer,
of Cummings, Georgia. The money was seized under the
RICO (Racketeer Influenced and Corrupt Organizations)
Act, but the state did not file supporting materials.
In ordering the return of the money, Bagley wrote: "The
State has had approximately seven months to file a
post-seizure complaint and has failed to do so."
Attorney Robert Rivas, who represents Final Exit, said
the vast majority of the $330,000 "came from people who
made contributions to engage in their First
Amendment-protected right to advocate publicly for
choices in dying."
